Terms of Service

Article 1 (Application)

1. These Terms of Service (these "Terms") set forth the conditions for using Flops (the "Service") between users of the Service ("Users") and the Service operator ("we" or "us").
2. Users shall use the Service only after agreeing to these Terms.
3. Any privacy policy, guidelines, or other rules we publish regarding the Service form part of these Terms.

Article 2 (Definitions)

In these Terms:

1. "Content" means any text, data (including poker hand histories), settings, and other information that Users input, transmit, store, or share via the Service.
2. "Share Link" means a URL or identifier issued by the Service to share Content with third parties.
3. "Third-Party Services" means external services we use to provide the Service, such as Google authentication and Cloudflare.

Article 3 (Service Description)

1. The Service is a poker hand replayer designed for recording, recreating, and sharing game situations for learning and review. It is a web application that enables Users to create, view, and share poker hand replays by inputting poker hand histories and related information.
2. The Service does not provide, broker, or facilitate any wagering, betting, or real-money transactions. Users are responsible for ensuring their use complies with applicable laws in their jurisdiction.
3. Share Links do not have an expiration period; however, we may invalidate or delete Share Links for operational reasons.
4. We may change, add, or discontinue the Service (in whole or in part) without prior notice.

Article 4 (Account Registration)

1. Users shall log in to the Service using their Google account.
2. Users shall manage their account at their own responsibility.
3. Users shall not allow third parties to use their account.
4. The Service is intended for users aged 16 or older. Users under 16 years of age may not use the Service.
5. Users represent that their use of the Service is lawful in their jurisdiction.

Article 5 (Prohibited Actions)

Users shall not engage in the following acts when using the Service:

1. Acts that violate laws or public order and morals
2. Acts related to criminal activities
3. Acts that interfere with the operation of the Service
4. Acts that infringe the rights of other Users or third parties
5. Acts that impose excessive load on the servers or networks of the Service
6. Acts that intentionally exploit bugs or defects in the Service
7. Acts of impersonating us or third parties
8. Providing benefits to anti-social forces or similar activities
9. Accessing the Service via scraping, crawling, or automated means without our permission, or generating/transmitting Content at scale
10. Guessing, brute-forcing, or attempting unauthorized access to Share Links created by others
11. Using the Service to operate, solicit, broker, or facilitate illegal gambling activities or illegal transactions (the Service does not provide or broker wagering)
12. Other acts that we deem inappropriate

Article 6 (User Content)

1. Users are solely responsible for their Content.
2. Users should not include third-party personal data or confidential information in Content. If a dispute arises due to Content, Users shall resolve it at their own expense and responsibility.
3. Users grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, transmit, and make technical modifications to Content to the extent necessary to provide, operate, and improve the Service.
4. We may remove, restrict access to, or make private any Content that may violate these Terms or applicable laws, or that is subject to a credible rights infringement claim, without prior notice.

Article 7 (Fees and Plans)

1. The Service is currently provided free of charge.
2. We may introduce paid plans in the future for some or all features. If we do, we will notify Users via in-Service notices or other reasonable means.

Article 8 (Disclaimer)

1. The Service is provided "as is," and we make no warranties regarding the completeness, accuracy, usefulness, or any other aspect of the Service.
2. We shall not be liable for any damages arising from the use of the Service.
3. The Service may be suspended or interrupted without notice.
4. We are not responsible for damages caused by User Content, Share Link expiration, Third-Party Service outages, or failures of networks/devices.
5. The Service does not provide medical, legal, financial, or other professional advice, and does not guarantee outcomes related to poker performance or results.
6. The Service provides hand recording and replay functionality only. It does not involve any real-money transactions or wagering.

Article 9 (Intellectual Property Rights)

1. All intellectual property rights related to the Service, including copyrights and trademarks, belong to us or the rightful owners.
2. Users retain rights to their Content, subject to the license granted to us under Article 6.

Article 10 (Account Deletion)

1. Users may delete their account at any time.
2. After account deletion, we will endeavor to delete the User's Content and related data within a reasonable period. However, some data may be retained for a limited period due to technical constraints (e.g., backups/logs) or legal obligations.
3. To prevent abuse, we may restrict re-registration (re-login) using the same Google account for 7 days after account deletion.

Article 11 (Changes to Terms)

1. We may change these Terms at any time.
2. The revised Terms shall take effect when posted on the Service.
3. If a User uses the Service after changes, the User is deemed to have agreed to the revised Terms.

Article 12 (Governing Law and Jurisdiction)

1. These Terms shall be governed by and construed in accordance with the laws of Japan.
2. In the event of any dispute arising out of or in connection with the Service, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.
