Terms of Service

Article 1 (Application)
- These Terms of Service (these "Terms") set forth the conditions for using Flops (the "Service") between users of the Service ("Users") and the Service operator ("we" or "us").
- Users shall use the Service only after agreeing to these Terms.
- Any privacy policy, guidelines, or other rules we publish regarding the Service form part of these Terms.
Article 2 (Definitions)
In these Terms:
- "Content" means any text, data (including poker hand histories), settings, and other information that Users input, transmit, store, or share via the Service.
- "Share Link" means a URL or identifier issued by the Service to share Content with third parties.
- "Third-Party Services" means external services we use to provide the Service, such as Google authentication and Cloudflare.
Article 3 (Service Description)
- The Service is a poker hand replayer designed for recording, recreating, and sharing game situations for learning and review. It is a web application that enables Users to create, view, and share poker hand replays by inputting poker hand histories and related information.
- The Service does not provide, broker, or facilitate any wagering, betting, or real-money transactions. Users are responsible for ensuring their use complies with applicable laws in their jurisdiction.
- Share Links do not have an expiration period; however, we may invalidate or delete Share Links for operational reasons.
- We may change, add, or discontinue the Service (in whole or in part) without prior notice.
Article 4 (Account Registration)
- Users shall log in to the Service using their Google account.
- Users shall manage their account at their own responsibility.
- Users shall not allow third parties to use their account.
- The Service is intended for users aged 16 or older. Users under 16 years of age may not use the Service.
- Users represent that their use of the Service is lawful in their jurisdiction.
Article 5 (Prohibited Actions)
Users shall not engage in the following acts when using the Service:
- Acts that violate laws or public order and morals
- Acts related to criminal activities
- Acts that interfere with the operation of the Service
- Acts that infringe the rights of other Users or third parties
- Acts that impose excessive load on the servers or networks of the Service
- Acts that intentionally exploit bugs or defects in the Service
- Acts of impersonating us or third parties
- Providing benefits to anti-social forces or similar activities
- Accessing the Service via scraping, crawling, or automated means without our permission, or generating/transmitting Content at scale
- Guessing, brute-forcing, or attempting unauthorized access to Share Links created by others
- Using the Service to operate, solicit, broker, or facilitate illegal gambling activities or illegal transactions (the Service does not provide or broker wagering)
- Other acts that we deem inappropriate
Article 6 (User Content)
- Users are solely responsible for their Content.
- Users should not include third-party personal data or confidential information in Content. If a dispute arises due to Content, Users shall resolve it at their own expense and responsibility.
- Users grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, transmit, and make technical modifications to Content to the extent necessary to provide, operate, and improve the Service.
- We may remove, restrict access to, or make private any Content that may violate these Terms or applicable laws, or that is subject to a credible rights infringement claim, without prior notice.
Article 7 (Fees and Plans)
- The Service is currently provided free of charge.
- We may introduce paid plans in the future for some or all features. If we do, we will notify Users via in-Service notices or other reasonable means.
Article 8 (Disclaimer)
- The Service is provided "as is," and we make no warranties regarding the completeness, accuracy, usefulness, or any other aspect of the Service.
- We shall not be liable for any damages arising from the use of the Service.
- The Service may be suspended or interrupted without notice.
- We are not responsible for damages caused by User Content, Share Link expiration, Third-Party Service outages, or failures of networks/devices.
- The Service does not provide medical, legal, financial, or other professional advice, and does not guarantee outcomes related to poker performance or results.
- The Service provides hand recording and replay functionality only. It does not involve any real-money transactions or wagering.
Article 9 (Intellectual Property Rights)
- All intellectual property rights related to the Service, including copyrights and trademarks, belong to us or the rightful owners.
- Users retain rights to their Content, subject to the license granted to us under Article 6.
Article 10 (Account Deletion)
- Users may delete their account at any time.
- After account deletion, we will endeavor to delete the User's Content and related data within a reasonable period. However, some data may be retained for a limited period due to technical constraints (e.g., backups/logs) or legal obligations.
- To prevent abuse, we may restrict re-registration (re-login) using the same Google account for 7 days after account deletion.
Article 11 (Changes to Terms)
- We may change these Terms at any time.
- The revised Terms shall take effect when posted on the Service.
- If a User uses the Service after changes, the User is deemed to have agreed to the revised Terms.
Article 12 (Governing Law and Jurisdiction)
- These Terms shall be governed by and construed in accordance with the laws of Japan.
- In the event of any dispute arising out of or in connection with the Service, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.
